In Fernandez v. United States (Decided May 28, 2026), the Supreme Court ruled 8-1 that federal prisoners challenging the validity of their convictions cannot use the compassionate release statute (18 U.S.C. § 3582). Instead, they must proceed through traditional habeas corpus or post-conviction relief (28 U.S.C. § 2255).

No way in hell Tampa's on the run Osama Sam Mustafa would have turned himself to authorities in Jordan on Oct 9th 2019 as he knew a 20 year prison sentence awaited him in a West Virginia federal prison, more or less a death sentence at his age, 59. FLORIDA BULLDOG WRITES 11/11/2021....“The FBI is seeking to indict Mohdar Abdullah (MA) in the Southern District of New York (SDNY) for providing material support to 9/11 hijackers Nawaf al-Hazmi and Khalid al-Mihdhar. Mohdar Abdullah is the subject of San Diego’s full field investigation,” say newly revealed parts of an FBI memorandum about “updates and initiatives (as of 5 October 2012).” Abdullah was well known to the FBI. Among other things, he and other subjects of interest in the case worked with Hazmi in the fall of 2000 at a Texaco gas station in Mesa, CA owned by Osama “Sam” Mustafa. Mustafa’s involvement is outlined in the 2012 report. Mustafa has denied having any terrorist connections, but was convicted in April 2013 in a $17.7-million conspiracy to profit from phony federal income tax refunds. He fled the country before sentencing, but was captured last year in Jordan. The FBI initially blanked out the identity of its criminal target, citing national security and other reasons when the 2012 report was first provided to Florida Bulldog in 2016. Bulldog had sued to obtain the report under the Freedom of Information Act after it was mentioned briefly in the final report of the FBI’s 9/11 Review Commission in 2015. The code name Operation Encore also was redacted at the time. Mustafa was first investigated by the FBI in 1991 after he told a police officer that the US needed another Pan Am 103 airliner bombing and that he could be the one to carry out the attack.On December 21, 1988, on a cold and ultimately chilling evening just four days before Christmas, Pan Am Flight 103 took off from London’s Heathrow Airport bound for New York City. 

Among the 259 passengers and crew on Pan Am 103 were 190 Americans, of which 35 were Syracuse University students. They never made it home. Less than 40 minutes into the flight, the plane exploded over the sky above Lockerbie, Scotland, killing everyone on board and 11 Scots on the ground. Until 9/11, Pan Am 103 was one of the world’s most lethal acts of air terrorism and one of the largest and most complex acts of international terrorism ever investigated by the FBI. Sam Mustafa also said all Americans should be killed because of the 1991 Iraq War.
