CARVANA LLC LAWSUITS ACROSS USA JUDGE REFUSES TO DISMISS CLASS ACTION LAWSUIT

UPDATE DEC 12, 2022 BEGINNING OF THE END FOR CARVANA: Hundreds of car buyers from Maryland and nearby states are part of the class-action lawsuit against Carvana. The company wanted a federal judge to toss it out, but the judge didn't. Carvana denies any and all liability. The company attempted to get the case thrown out, claiming it was without merit. The company filed a motion to compel or force arbitration and dismiss the case but a federal judge denied it. Attorney Phillip Robinson is one of the attorneys representing Carvana customers in the lawsuit. When asked what the judge's ruling means, Robinson said: "It means the case gets to go forward. Their effort to have it dismissed, saying we haven't pled legal claims is denied." Robinson said hundreds of people across the country have been impacted. "No one buys a car to sit in the driveway. People buy a car to get to work or school or to go see family members. It's troubling to us the cavalier approach to selling a car that you can't provide title to," he said.

UPDATE Jan 26, 2022 It is well known that Carvana gets their vehicles at auto auctions from all around the country. Most used car dealers must pay cash at the auction to take home a car, but it appears to me Carvana, being so huge, is able to purchase cars from auto auctions on credit. If Carvana had paid for the cars they would have access to the titles from each individual State. It appears to me that Carvana is selling vehicles that they don't actually own, that is most likely what is happening with Carvana. Sometimes when a used car dealer pays the car off it can take 2 to 3 weeks to get the title, but not the time frame Carvana is claiming, so they are floating the money. Or Carvana has really slow credit accounts with auto auctions around the country which is just as bad, which will delay titles to Carvana customers for months. You best bet is to file a complaint with the Carvana BOND company with your DMV state office, this will cause a call to action by the DMV who can pull Carvana's license.

Dozens of Carvana customers have filed complaints with the state for months-long delays in getting their vehicle’s title and registration. Stuck with expired and at times out-of-state temporary tags, Carvana customers told the CBS 11 I-Team they are worried about being ticketed or towed. Since 2019, according to state records, the Texas Department of Motor Vehicles has cited Carvana with more than 30 violations along with issuing more than $10,000 in fines for violating state registration laws.

In August 2021, Carvana received a six-month suspension from selling cars from its dealership in Raleigh, N.C., for violating the state's dealer laws. May 29th, 2020.The billionaire father and son behind online used car seller Carvana have been accused of insider trading in a lawsuit filed in Delaware by shareholders. The suit, first reported by Bloomberg Law, alleges that Ernie Garcia II, and his son, Ernie Garcia III, engaged in self-dealing, using the coronavirus pandemic as an excuse to buy shares at “bargain basement” prices even though they knew Carvana had “a strong balance sheet.” The suit was filed by pension fund shareholders in St. Paul, Minnesota, and also names the company’s directors and investment firms controlled by the Garcias. Carvana did not respond to a request for comment from Forbes.

Aug 3rd, 2021 Los Angeles County District Attorney George Gascón announced today that Carvana, an online retailer selling cars using multi-story vending machines, will pay $850,000 to settle a civil lawsuit alleging the company was operating in California without a dealer’s or transporter’s license.“Not having a business license is illegal, opens your company up to lawsuits and is unfair to the consumer,” District Attorney Gascón said. “Business owners have the responsibility to obtain the licenses needed to operate their business legally.” The Los Angeles District Attorney’s Consumer Protection Division led the investigation and prosecution in this case, which also involved the district attorney’s offices in San Diego, Santa Clara and Ventura counties.

Aug 10th, 2021 Vending machine out of order: Carvana loses license to sell in Wake Co until 2022. Raleigh, N.C. — The company known for car vending machines is banned from selling cars in Wake County until next year. The North Carolina Division of Motor Vehicles sued Carvana based on a consumer complaint and revoked Carvana’s dealer’s license for violating dealer licensing laws. In July, Carvana was the top seller of used cars in the state, titling 587 vehicles statewide during the month. Specifically, the DMV claimed in the suit that Carvana failed to deliver titles to the DMV, sold cars without a state inspection and issued out-of-state temporary tags for a vehicle sold to a person in North Carolina, same thing is happening in Florida, what the hell?

Following is a typical complaint filed by a customer of Carvana with the BBB, BUYER BEWARE: As of 09/24/2021, I purchased a vehicle in Feb, 2021. They were supposed to transfer my existing tag to the new vehicle. I have had several temporary tags issued from Carvana. I still can't get a reason why I don't have my new tag transfer. As of today, I have an expired temporary tag, and they apparently can't issue me a new one, meanwhile they have all of the paperwork to transfer tags and no one can give me an answer. I am about to have my car voluntarily repossessed just so I can have a new car with a tag.
