Now more than a decade later, Smith is still alive in jail, and is now appealing his sentence before Sarasota County Judge Andrew Owens, arguing his sentence is no longer valid under new Florida Law. "There have been a series of court decisions from the Supreme Court and the Florida Supreme Court that effect more than half the people on Florida's death row," said defense attorney in the 2004 case, Adam Tebrugge. "Among those people is Joseph Smith." This comes after the U.S. Supreme Court found Florida's death penalty to be unconstitutional, placing too much power in the hands of a judge and not enough in the hands of the jury. Governor Rick Scott signed a bill into law that requires a unanimous jury recommendation before the death penalty can be imposed. It's retroactive. That means dozens of cases long thought closed could now be revisited, including Smith's. "It appears almost certain that Joseph Smith's death sentence will be reversed," said Tebrugge, "and his case will go back to Sarasota County for a new re-sentencing trial."

A Death Row cell is 6 x 9 x 9.5 feet high. Florida State Prison also has Death Watch cells to incarcerate inmates awaiting execution after the Governor signs a death warrant for them. A Death Watch cell is 12 x 7 x 8.5 feet high. Men on Death Row are housed at Florida State Prison in Starke, FL, and Union Correctional Institution in Raiford, FL. The women on Death Row are housed at Lowell Correctional Institution Annex in Lowell, FL. Inmates may receive mail every day except holidays and weekends. They may have cigarettes, snacks, radios and 13″ televisions in their cells. They do not have cable television or air-conditioning (get used to the heat, hell is next) and they are not allowed to be with each other in a common room.

The Pincus clan tried to pull the MFFG website (most photos are gone) from the Internet, but I found enough bits and pices to profile the site. SARASOTA COUNTY Publication Date: 14-FEB-04– The one-story house on 24th Parkway had been the talk of the neighborhood for months, as neighbors gossiped about scantily clad young women running in and out at all hours of the night. “We would see lots of men — most stayed five or 10 minutes and left,” said a neighbor who has lived next door for two months. “The girls would leave with them in different cars, a couple times a night.”
The National Enquirer reports that the Pincuses run a Web site called Minc’s Fantasy Fighter Girlz, or MFFG. On the site, “Minc” is described as “owner and Mom to all the girlz.” The name of the recipient for checks and money orders is Jeff Pincus, the co-owner (Cash Business). The Florida State Department Web site shows no businesses licensed under the names MFFG or Fantasy Fighting Girlz, and Pincus isn’t listed. (IRS should be interested in Federal Tax Returns) In all, five girls work for MFFG. The Web site boasts that “MFFG is family-owned, operated and copy-written.” A public records search indicates that Naomi Pincus is also known as Naomi Castro, and that three young women with that last name live or have lived in the house in the 3400 block of 24th Parkway. According to MFFG’s Web site, the three girls are sisters.

A surveillance video showing Carlie Brucia being led away by a man in a grayish blue mechanic’s uniform was broadcast on TV across the country. Photos obtained form the MFFG website show a young blonde girl who looks just like Carlie Brucia, right down to the type of ponytail scrunchie she was wearing. Sheriff’s officials arrested Smith based on leads generated by the film. The Brucia/Smith court records had been sealed by Circuit Judge Andrew Owens. An attorney representing the Sarasota Herald-Tribune requested access to the records, saying they would help him defend the newspaper in a civil suit related to the Brucia case. Jeff and Naomi Pincus had field two major law suits to shut up the Sarasota Herald Tribune aka the New York Times Southern Division and against the National Enquirer in the Spring of 2004, local attorney Daniel Hoffman represented the Pincus’s in both law suits, see Sarasota county Case Number 2004 CA 002854 NC and Case Number 2004 CA 003477 NC. In the suit, Jeffrey and Naomi Pincus, a Sarasota couple who lived in the house where Smith was arrested, claim the Sarasota Herald-Tribune defamed them and they wnated $4.5 Million. They say the newspaper published “lies and half-truths” in an article about a Web site and video business linked to the couple. According to the article, Jeffrey Pincus’ name was listed on a Web site called Minc’s Fantasy Fighter Girlz (he was click here).
I, (Bill Warner private investigator), had been doing surveillance on 24th Parkway Sarasota Fl during December 2003 and January 2004 not too far from the home Jeff and Naomi Pincus, I was very aware of an assortment of men coming to the Pincus house at all times of the day, I was not there at night. During the months of August 2003 to January 2004, Joseph P. Smith lived at 24th Parkway Sarasota Fl with Jeffrey and Naomi Pincus and a constant parade of young females, from 17 to 22, who were video taped wrestling in various forms of undress or school girl uniforms. Right after the murder of Carlie Brucia on 2/01/04 I was aware that I had done surveillance for the past 60 days just down the street from the house where Joseph P. Smith as my cameras were pointed in the opposite direction. But I was aware of heavy day time traffic to the residential home of the Jeff and Naomi Pincus as the cars and trucks had to pass directly in front of me.
I downloaded all of the Mincs’ Fantasy Fighting Girlz website information along with photos from MFFG and accessed all of the videos that they were promoting, it was nothing but pure sleaze aimed at “40 ish” men with very young females ‘wrestling‘. One of the females, Storm, was a look-a-like for Carlie Brucia (click on image to enlarge). Both girls were about the same height, with long blonde hair (pulled back in a pony tail) and both had blue eyes and fair skin. I provided all of my information, surveillance photos, web photos with story boards, TMJ Productions information, and website address links of MFFG, (obtained on my own and working for no-one), to Gregg Thomas the attorney for the Sarasota Herald Tribune aka the NY Times and the National Enquirer in June of 2004. The Pincus clan had filed suit against the Sarasota Herald Tribune aka the NYT in March of 2004 and against the National Enquirer in April of 2004, they got nothing.
There are direct links in the type of violent wrestling attack, rape and strangulation murder of Carlie Brucia by Joseph P. Smith that took place in the back of the 1992 Buick station wagon, (that Smith had borrowed from Jeff Pincus), to the type of videos sold by Jeff Pincus and the multiple videos taped in the house of Jeff Pincus, when Joe Smith was living there…Jeff and Naomi Pincus said they have been shunned by former colleagues and friends after scrutiny began to center on their north Sarasota home. Smith, who had been kicked out of his home, stayed with the Pincuses and authorities say he used their station wagon in the abduction and murder. Subsequent newspaper reports said the Pincuses ran a sexually suggestive Web site. The family (Pincus) contends the articles included lies and had sued, asking for a settlement of $4.5-million (they got nothing) from the Sarasota Herald Tribune and the National Enquirer. They also have left town. “They couldn’t stand to face the community,” said Daniel Hoffman, the family’s attorney….Did the Pincus home atmosphere with the sexually super-charged violent girl on girl vidoes being produced every week and strange men paying $350.00 to come to the house and “wrestle” with the girlz, have anything to do with influencing Joseph P. Smith (in his booze and drug induced haze) to grab a girl off the Sarasota Streets on Feb 1st 2004 who just happened to look just like one of the Mincs’ Fantasy Fighting Girlz ? Looks like I saved the Sarasota Herald Tribune and the NY Times about $4.5 Million Dollars.
